Area of Practice:Civil Law Barrister

 
A civil specialist principally specialising in personal injury with an established 
 practice also covering professional negligence, land and planning and malicious falsehood.  Deals with high value ancillary relief cases.  A Deputy District Judge (Civil).

I served in The Royal Navy for 12 years (including The Falklands War) and started practising at the Bar while still serving, appearing at Courts Martial for my last two years of service.  My career included 2 appointments at sea, working as an Officer Recruiting Officer and later security and legal work.  After leaving the Regular Navy I continued to serve in the Royal Naval Reserve for several years.

I have practised as a Barrister in Exeter since 1988, and specialised in civil work since 1996.  I am head of the Civil Team at Walnut House.

Personal Injury

This is my principal specialist area.  I am a member of the Personal Injuries Bar Association, and have been involved in Personal Injuries work at all levels for about 20 years.  I have a large number of conditional fee cases, and also act for a wide range of insurance clients. I also have considerable experience in associated areas such as inquests (usually for the family of the deceased) and Health and Safety cases (civil and criminal, and including appearing on behalf of local government).  In addition, my practice extends to education negligence and sports cases, and to cases against the MOD, the Police and Local Authorities. 

Other Civil

I act principally in land work, especially in boundary disputes and ownership disputes.  I also accept instructions in cases involving planning, professional negligence and malicious falsehood.

Family

I accept instructions in relation to high value ancillary relief cases, an area in which I have considerable experience.

I have an interest in Advocacy Training, and have taught at the University of Exeter and on the Legal Practice Course training solicitors. I have also conducted overseas course in Advocacy on behalf of the British Council, at the University of Malaysia (twice) and in Mauritius.

Cases of Note:

C -v- M - penalty interest in substantial Personal Injury case involving a false allegation by insurers of malingering.

A -v- Bracknell Borough Council - House of Lords consideration of Dyslexia and Education Negligence.

L -v- F - brain injured young man in apparently hopeless case, won 40 percent at first instance and held on appeal.
